These Terms and Conditions apply to all of our services provided directly or indirectly via the Internet, any type of mobile device, by email, or by telephone. By accessing our website, using our applications, and/or making a reservation, you confirm that you have read, understood, and agree to these Terms and Conditions (and Privacy Policy). These Terms and Conditions are subject to occasional changes.

Through this website, we provide an online platform through which

a) Bus companies that offer bus services (passenger transportation) and allow visitors to this website to make reservations;
b) Tour operators that offer travel services and allow visitors to this website to make reservations;
c) Businesses and companies provide information about their destinations and local conditions that are suitable for tour groups.

By making a reservation on this website, you enter into a legally binding contractual relationship with the bus company or tour operator through which you are booking. From the time of your reservation, we act solely as an intermediary between you and the bus company or tour operator. During the booking process, you will receive a booking confirmation via email from us on behalf of and in the name of the bus company or tour operator you have booked. Upon booking, we forward the details of your booking to the bus company or tour operator you have booked. The information, data, availability, prices, and rates we use to provide our service are based exclusively on the information provided to us by the bus companies, tour operators, and other businesses.
The participating bus companies and tour operators have access to our system and are therefore solely responsible for ensuring that all information (prices, travel and hotel information, availability, etc.) listed on our website is kept up to date. Responsibility for the information provided regarding destinations also lies solely with the listed businesses, although busfinder.com will promptly correct or update any changes communicated in writing. We cannot guarantee that all information provided by the participating bus companies or tour operators is accurate and complete. Furthermore, we cannot be held responsible for obvious errors, typos, or misprints; for temporary or partial service interruptions; for inaccurate or false information; or for the failure to transmit information. Our website does not constitute a recommendation or endorsement of the quality, service level, qualifications, or classification of the buses and/or trips and should not be construed as such. Our services are available solely for private and non-commercial use. Therefore, you are not permitted to distribute, link to subpages of our website, use, copy, republish, upload, or reproduce any content, information, software, products, or services available on our website for commercial or competitive purposes.

All prices on our website are retail prices and are displayed inclusive of all taxes. Additional fees and/or charges for bus rentals and package tours that are not included in the price are listed under “Services Not Included.”
In the case of bus rentals, any access, entry, and parking fees, as well as overnight accommodations for the driver(s) on multi-day trips, are NOT included. The travel times calculated during route planning are, without exception, approximate. However, under normal traffic conditions, the travel times correspond to empirical values for tour buses. EBA busfinder GmbH assumes no liability for the calculated travel times.

Our service for online bookings made directly through us is free of charge; no additional booking fees are added to the rental and/or travel price.
Bus companies and tour operators pay a commission—a small percentage of the rental or travel price—to busfinder.com.

5.a) Payment of the Rental Fee to Bus Companies: Payment of the rental fee is processed exclusively through the bus company providing the service. When booking “partner buses,” payment processing is handled by busfinder.com acting as an intermediary for commercial services.

5.b) Payment of the Travel Price to Tour Operators: Payment of the travel price may be made online or “on account.” The payment option is determined by the respective tour operator offering the trip. In the case of “payment on account,” the payment(s) are processed exclusively through the tour operator offering the trip.

Before booking, please review the payment and cancellation policies provided by the bus company or tour operator and displayed on our website, as well as the general terms and conditions and travel terms and conditions.

Provided that the travel service offered and booked is subject to the current provisions of the Package Travel Act, our platform will provide you —for your personal protection—will be provided with all pre-contractual information that complies with the disclosure requirements under the currently valid version of the Package Travel Act by the tour operator prior to booking. busfinder.com cannot be held responsible for inaccurate or false information provided by the tour operator, or for the failure to provide or transmit information in accordance with the disclosure requirements under the Package Travel Act.

When booking through a tour operator, you have the option to purchase travel or cancellation insurance directly during the booking process, or to request it via email as indicated. We generally recommend purchasing this insurance, especially for trips lasting several days.

Pursuant to Section 1(2)(8) and (3) of the Distance and Off-Premises Sales Act (FAGG), the FAGG does not apply to package tours and their brokerage, nor to the transportation of passengers, with the exception of the information requirements for electronic contracts under Section 8 of the FAGG. The 14-day right of withdrawal under the FAGG therefore does not apply to contracts for package tours and passenger transportation that we arrange. Furthermore, pursuant to Section 18(1)(10) of the FAGG, customers have no right of withdrawal with respect to services in the areas of accommodation for purposes other than residential purposes, the transportation of goods, the rental of motor vehicles, and the delivery of food and beverages, as well as services provided in connection with recreational activities.

8.a By booking with a bus company, you accept its terms and conditions regarding cancellations and no-shows. Cancellations must be made using the link provided at the time of booking. The bus companies’ general terms and conditions regarding cancellations and no-shows are displayed on our website. During the booking process, you must accept the terms and conditions of the bus company providing the service. Please carefully review the bus company’s terms and conditions before booking.
If you wish to cancel your booking, please locate your confirmation email and follow the booking link provided therein. You can cancel your booking via this link. Please note that, in accordance with the bus company’s policies regarding cancellations and/or no-shows, you may be charged a fee or may not be entitled to a refund of the amount paid (in advance). Please remember to make payments on time, as they may be required to secure your reservation. Requests to change your booking can be made via email; however, whether such changes can be accommodated is at the sole discretion of the bus company as your contracting partner.

8.b By booking with the respective tour operator, you accept its “General Terms and Conditions of Business and Travel,” which are provided to you before and during the booking process. Cancellation of the booked travel services must be made through the tour operator with whom you booked and must be submitted in writing. Please note that, in accordance with the tour operator’s terms and conditions regarding cancellations and/or no-shows, you may be charged a fee or may not be entitled to a refund of the amount paid (in advance). If you are paying “by invoice,” please remember to make payments on time, as these may be necessary to secure your reservation. In the event of claims or cancellations involving travel and cancellation insurance policies booked or purchased through our website, please contact our booking and service center.

By completing your booking, you agree to receive an email that we may send you shortly before your departure date, containing information about your destination and offers (including third-party offers) relevant to your booking and destination. Furthermore, by making this booking, you agree to receive an email that we may send you immediately after the rental period or the travel service has ended, asking you to fill out the customer review form. Please note that the default ranking setting is based on a fully automated ranking system that uses various criteria. To make it easier for you to use our website, we also offer other settings that allow you to customize the “ranking.”
The full customer review can be accessed on the corresponding information page for the respective bus company or tour operator on our website. This is intended solely to inform (future) guests about the service and overall quality of the bus company or tour operator. busfinder.com reserves the right to withhold reviews after review and to request an amendment from the guest who submitted the review if the review:

• contain personal information about other people (e.g., names, sexual orientation, etc.),
• contain advertising, spam, or links,
• constitute defamation or are intended to disparage,
• report on facts that require more specific information or evidence.

The guest review form can be considered a survey and does not contain any additional (commercial) offers, invitations, or other promotional materials. The busfinder overall rating of the vehicle (0–5 points) takes into account seat spacing, amenities, year of manufacture, and manufacturer.

In accordance with these General Terms and Conditions and within the scope of applicable law, we are liable only for direct damages incurred by you as a result of our failure to fulfill our obligations regarding our services, but only up to the total amount of the booking.

Unless otherwise stated, the software used for our services or for our website and available on it, as well as the intellectual property (including copyrights) in the content and applications on our website, are the property of busfinder.com, its partners, or providers.
busfinder.com holds exclusive ownership of all rights, titles, and interests in the appearance and design—including the infrastructure—of the website through which the service is available (including guest reviews and translated content). You are not authorized to copy, scrape, link to, publish, advertise, market, integrate, obtain, use, or link to the content or the busfinder.com brand (including any translations and guest reviews). Should you use or link to our (translated) content (including guest reviews) (in whole or in part) or hold any intellectual property rights to the website or any (translated) content (including guest reviews) in any form, you hereby assign and transfer such rights to busfinder.com. Any unlawful use and any of the aforementioned actions or conduct constitutes a material infringement of our intellectual property rights (including copyright and database rights).

To the extent permitted by law, these Terms and Conditions, as well as the provision of our services, are governed by Austrian law and shall be interpreted accordingly. All disputes arising from these Terms and Conditions and our services shall be brought exclusively before the competent courts in Graz, Austria.
The English translation is based on the original German text. The translated version of the German terms and conditions is provided as a courtesy and is intended solely for informational and internal purposes. In the event of any disputes, inconsistencies, or discrepancies between the German version and the version in another language, the German version shall prevail and be binding within the framework of applicable legal provisions. You can find the German version on our website (if you select German as the language) or it will be sent to you in writing upon request.
If any provision of this contract is or becomes invalid, unenforceable, or non-binding, all other provisions applicable to the contracting parties shall remain unaffected. In such a case, the contracting parties shall replace the invalid or non-binding provision, in accordance with statutory provisions, with a valid and binding provision that, in light of the content and purpose of this contract, has an effect as similar as possible to that of the invalid, unenforceable, or non-binding provision.
